To make visiting our website attractive and to enable the use of certain functions, we use cookies, which are small text files stored on your device. Some of these cookies are automatically deleted after closing the browser (so-called "session cookies"), while others remain on your device for a longer period and enable the storage of page settings (so-called "persistent cookies"). 7) Use of Customer Data for Direct Marketing

7.1 Newsletter Subscription

If you subscribe to our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. The provision of further data is voluntary and is used to address you personally. For sending the newsletter, we use the so-called double opt-in procedure, which ensures that you only receive newsletters when you have explicitly confirmed your consent to receive newsletters by activating a verification link sent to the email address provided.

By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 Para. 1 lit. a GDPR. In this context, we store your IP address registered by the Internet Service Provider (ISP) as well as the date and time of registration to be able to trace any possible misuse of your email address at a later date. The data collected by us when subscribing to the newsletter will be used strictly for the intended purpose.

You can unsubscribe from the newsletter at any time using the link provided in the newsletter or by sending a corresponding message to the controller mentioned at the beginning. After unsubscribing, your email address will be immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to further data use that is legally permitted and about which we inform you in this statement.

Subject to your explicit consent in accordance with Art. 6 Para. 1 lit. a GDPR, the provider also performs a statistical success evaluation of email campaigns using web beacons or tracking pixels in the emails sent, which can measure opening rates and specific interactions with the content of the newsletter. In this process, device information (e.g., time of access, IP address, browser type, and operating system) is also collected and evaluated, but not merged with other data sets.

You can revoke your consent to email tracking at any time with effect for the future.

8) Data Processing for Order Fulfillment

8.1 Transmission of image files for order processing via upload function

On our website, we offer customers the opportunity to personalize products by submitting image files via an upload function. The submitted image motif is used as a template for the personalization of the selected product.

Via the upload form on the website, the customer can submit one or more image files from the memory of the device used directly to us via automated, encrypted data transfer. We then collect, store, and use the submitted files exclusively for the production of the personalized product in accordance with the respective service description on our website. If the submitted image files are passed on to special service providers for the production and processing of the order, you will be explicitly informed about this in the following paragraphs. No further disclosure will take place. If the submitted files or digital motifs contain personal data (in particular images of identifiable persons), all the processing operations just mentioned are carried out exclusively for the purpose of processing your online order in accordance with Art. 6 Para. 1 lit. b GDPR.

After final processing of the order, the submitted image files will be automatically and completely deleted.

8.2 Insofar as it is necessary for contract fulfillment for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 Para. 1 lit. b GDPR.

If we owe you updates for goods with digital elements or for digital products based on a corresponding contract, we will process the contact data you provided when ordering to inform you personally within the framework of our legal information obligations in accordance with Art. 6 Para. 1 lit. c GDPR. Your contact data will be used strictly for the purpose of communicating updates owed by us and will only be processed by us to the extent necessary for the respective information.

For the processing of your order, we also cooperate with the following service provider(s) who assist us fully or partially in the execution of concluded contracts. Certain personal data will be transmitted to these service providers in accordance with the following information.

8.3 To fulfill our contractual obligations to our customers, we work with external shipping partners. We pass on your name and delivery address and, if necessary for delivery, your telephone number, exclusively for the purpose of goods delivery in accordance with Art. 6 Para. 1 lit. b GDPR to a shipping partner selected by us.

8.4 Use of payment service providers

- Amazon Pay

One or more online payment methods of the following provider are available on this website: Amazon Payments Europe s.c.a., 38 avenue J.F. Kennedy, L-1855 Luxembourg

If you select a payment method from the provider where you make an advance payment (such as credit card payment), your payment data (including name, address, bank and payment card information, currency, and transaction number) and information about the content of your order will be transmitted to this provider in accordance with Art. 6 Para. 1 lit. b GDPR. In this case, the transmission of your data is exclusively for the purpose of payment processing with the provider and only to the extent necessary for this.

- Google Pay

If you choose "Google Pay" as the payment method from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), payment processing will take place via the "Google Pay" application on your mobile device running at least Android 4.4 ("KitKat") and equipped with an NFC function, by charging a payment card stored with Google Pay or a verified payment system there (e.g., PayPal). To authorize a payment via Google Pay exceeding €25, it is necessary to first unlock your mobile device using the respective verification measure (such as facial recognition, password, fingerprint, or pattern).

For payment processing, the information you provided during the order process, along with information about your order, will be transmitted to Google. Google will then transmit your payment information stored in Google Pay in the form of a uniquely assigned transaction number to the originating website, which verifies a completed payment. This transaction number does not contain any information about the actual payment data of your payment methods stored with Google Pay, but is created and transmitted as a unique numerical token. In all transactions via Google Pay, Google acts merely as an intermediary for the payment process. The transaction is carried out exclusively between the user and the originating website by charging the payment method stored with Google Pay.

If personal data is processed during the described transmissions, the processing is carried out exclusively for the purpose of payment processing in accordance with Art. 6 Para. 1 lit. b GDPR.

Google reserves the right to collect, store, and evaluate certain process-specific information for every transaction made via Google Pay. This includes the date, time, and amount of the transaction, merchant location and description, a description of the goods or services purchased provided by the merchant, photos you have attached to the transaction, the name and email address of the seller and buyer or sender and recipient, the payment method used, your description of the reason for the transaction, and, if applicable, the offer associated with the transaction.

According to Google, this processing is carried out exclusively in accordance with Art. 6 Para. 1 lit. f GDPR on the basis of the legitimate interest in proper accounting, verification of transaction data, and the optimization and maintenance of the Google Pay service.

Google also reserves the right to combine the processed transaction data with other information collected and stored by Google when using other Google services.

In this case, the transmission of your data is exclusively for the purpose of payment processing with the provider and only to the extent necessary for this.

If you select a payment method where we make an advance payment, you will also be asked to provide certain personal data (first and last name, street, house number, postcode, city, date of birth, email address, telephone number, if applicable, data on an alternative payment method) during the ordering process.

To protect our legitimate interest in ascertaining your creditworthiness in such cases, this data is forwarded by us to the provider for a credit check in accordance with Art. 6 Para. 1 lit. f GDPR. Based on the personal data you provide, as well as other data (such as shopping cart, invoice amount, order history, payment experiences), the provider checks whether the payment option you selected can be granted in view of payment and/or default risks.

The credit report may contain probability values (so-called score values). Insofar as score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. Address data, among other things, but not exclusively, flows into the calculation of the score values.

You can object to this processing of your data at any time by sending us a message or by contacting the provider. However, the provider may still be entitled to process your personal data if this is necessary for contractual payment processing.

8.5 Electronic cancellation function for distance contracts

Consumers who conclude contracts on this website for which a statutory right of withdrawal exists have the option of declaring the withdrawal via an electronic cancellation function in accordance with the applicable cancellation provisions.

For the provision of the electronic cancellation function, we use a solution from the following provider: Visionz GmbH, Richthofenstraße 29, 31137 Hildesheim, Germany.

When using the cancellation function, in addition to information for identifying the contract to be canceled, other personal information such as the first and last name and the e-mail address of the consumer must be provided or confirmed.

This information is initially collected by the provider based on our legitimate interest in a user-friendly, stable and process-optimized solution in accordance with Art. 6 Para. 1 lit. f GDPR, then used to confirm receipt of the cancellation declaration on our behalf by e-mail, and finally transmitted to us. We then process the transmitted information for the proper processing of the cancellation in accordance with Art. 6 Para. 1 lit. b GDPR and Art. 6 Para. 1 lit. c GDPR based on our legal obligation to provide an electronic cancellation function for paid consumer distance contracts.

The information collected by the provider is routinely deleted after the final processing of a cancellation, unless there are legal retention obligations to the contrary.

We have concluded a data processing agreement with the provider, which protects data processed within the framework of the cancellation function and prohibits unauthorized transfer to third parties.

9) Retargeting/Remarketing and Conversion Tracking

9.1 Meta Pixel

Within our online offering, we use the "Meta Pixel" service from the following provider: Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland ("Meta")

If a user clicks on an advertisement placed by us on Facebook and/or Instagram, the URL of our linked page is extended by a parameter with the help of "Meta Pixel". This URL parameter is then entered into the user's browser by a cookie that our linked page itself sets after redirection.

This enables Meta, on the one hand, to determine the visitors to our online offering as a target group for the display of advertisements (so-called "ads"). Accordingly, we use the service to display the Facebook and/or Instagram ads placed by us only to users who have also shown an interest in our online offering or who have certain characteristics (e.g., interests in certain topics or products, which are determined based on the websites visited) which we transmit to Meta (so-called "Custom Audiences").

On the other hand, the "Meta Pixel" can be used to track whether users have been redirected to our website after clicking on an advertisement and what actions they perform there (so-called "conversion tracking").

The collected data is anonymous for us, so it does not allow us to draw conclusions about the identity of the users. However, the data is stored and processed by Meta, so that a connection to the respective user profile is possible and Meta can use the data for its own advertising purposes.

All the processing described above, in particular the setting of cookies for reading out information on the end device used, will only be carried out if you have given us your express consent in accordance with Art. 6 Para. 1 lit. a GDPR. You can revoke your given consent at any time with effect for the future by deactivating this service in the "Cookie Consent Tool" provided on the website.

We have concluded a data processing agreement with the provider, which ensures the protection of the data of our site visitors and prohibits unauthorized transfer to third parties.

The information generated by Meta is usually transferred to a Meta server and stored there; in this context, a transfer to servers of Meta Platforms Inc. in the USA may also occur.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European data protection level based on an adequacy decision of the European Commission.

9.2 Pinterest Retargeting Pixel

This website uses retargeting technology from the following provider: Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland

This enables us to specifically target visitors to our websites with personalized, interest-based advertising who have already shown interest in our shop and our products. The advertisements are displayed based on a cookie-based analysis of past and current usage behavior.

In the case of retargeting technology, a cookie is stored on your computer or mobile device to collect pseudonymized data about your interests and thus adapt the advertising individually to the stored information. These cookies are small text files that are stored on your computer or mobile device. You will then be shown advertisements that are highly likely to correspond to your product and information interests.

All the processing described above, in particular the setting of cookies for reading out information on the end device used, will only be carried out if you have given us your express consent in accordance with Art. 6 Para. 1 lit. a GDPR. Without this consent, retargeting technology will not be used during your visit to the site.

You can revoke your given consent at any time with effect for the future. To exercise your right of withdrawal, please deactivate this service in the "Cookie Consent Tool" provided on the website.

10) Page Functionalities

Endereco

To enable real-time checking of certain entries in the address form of our webshop's order process for input errors, we use the services of the following provider: Endereco UG, Balthasar-Neumann-Straße 4b, 97236 Randersacker, Germany

The provider validates the entered address, verifies the spelling, and adds any missing data. In the case of ambiguous addresses, correct alternative suggestions are displayed. For this purpose, the address data you enter is transmitted to the provider, stored there, and evaluated.

This processing is carried out in accordance with Art. 6 Para. 1 lit. f GDPR on the basis of our legitimate interest in the proper collection of the customer's correct address data for the conscientious fulfillment of our contractual delivery obligations and to prevent problems with contract execution.

The provider processes the data concerned separately and does not combine it with other data sets, and deletes it as soon as its status or correctness has been confirmed, but no later than after 30 days.

11) Rights of the Data Subject

11.1 The applicable data protection law grants you the following data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, whereby reference is made to the legal basis cited for the respective exercise conditions:

  • Right of access in accordance with Art. 15 GDPR;
  • Right to rectification in accordance with Art. 16 GDPR;

  • Right to notification in accordance with Art. 19 GDPR;
  • Right to data portability in accordance with Art. 20 GDPR;
  • Right to withdraw granted consents in accordance with Art. 7 Para. 3 GDPR;
  • Right to lodge a complaint in accordance with Art. 77 GDPR.

11.2 RIGHT TO OBJECT

IF WE PROCESS YOUR PERSONAL DATA WITHIN THE FRAMEWORK OF A BALANCING OF INTERESTS ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED. FURTHER PROCESSING, HOWEVER, REMAINS RESERVED IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS, AND FREEDOMS, OR IF THE PROCESSING SERVES THE ASSERTION, EXERCISE, OR DEFENSE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. YOU MAY EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

12) Duration of storage of personal data

The duration of the storage of personal data is determined by the respective legal basis, the purpose of processing and – if applicable – additionally by the respective statutory retention period (e.g. commercial and tax retention periods).

When processing personal data on the basis of explicit consent in accordance with Art. 6 Para. 1 lit. a GDPR, the data concerned will be stored until you revoke your consent.

If statutory retention periods exist for data processed within the framework of legal or quasi-legal obligations on the basis of Art. 6 Para. 1 lit. b GDPR, this data will be routinely deleted after the expiry of the retention periods, provided that it is no longer required for contract fulfillment or contract initiation and/or we no longer have a legitimate interest in further storage.

When processing personal data on the basis of Art. 6 Para. 1 lit. f GDPR, this data will be stored until you exercise your right to object in accordance with Art. 21 Para. 1 GDPR, unless we can demonstrate compelling legitimate grounds for the processing that outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defense of legal claims.

When processing personal data for direct marketing purposes on the basis of Art. 6 Para. 1 lit. f GDPR, this data will be stored until you exercise your right to object in accordance with Art. 21 Para. 2 GDPR.

Unless otherwise stated in the other information in this declaration about specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
